Information on data processing and protection
(information to customers – Articles 13 and 14 GDPR)

Pursuant to and for the effects of the combined provisions of the European Regulation 2016/679 (General Data Protection Regulation, hereinafter “GDPR”) and of the Legislative Decree 196/2003 and subsequent amendments (Legislative Decree. 101/2018), the company PANIFICIO NOMELLI SNC NOMELLI GRAZIANO & C in the person of the legal representative Mr. Nomelli Graziano, as Data Controller (hereinafter “Owner”), informs of the following.

Art. 1. Data Controller (the person or company who decides how and why to process the data).

Art. 2. Purpose and legal basis of the processing: why the data are processed and what is the reason for the processing
As part of one’s work, the acquisition and processing of personal data of customers, including banks, are necessary to correctly execute the provision of the service and / or product requested (by signing the quote, order and / or contract ) and to fulfill the related obligations under the civil and fiscal regulations, therefore consent is not required.
The purposes for which the specific and explicit consent of the interested parties is not required are:
– provide the requested product / service;
– issue estimates, formulate contract proposals, issue invoices, respond to requests from interested parties (for example requests received by e-mail, telephone);
– fulfill the pre-contractual, contractual and tax obligations consequent to this activity of the Data Controller;
– fulfill the obligations established by law, by a regulation, by community legislation or by an order of the Authority;
– exercise the rights of the owner, for example any right of defense in court.
The refusal to provide all or some of the data requested for the purpose a) and / or the indication of incomplete and / or untrue data by the interested parties prevents the Data Controller from fulfilling its obligations.

The legal basis that legitimizes the processing of data is:
• execution of a contract of which the interested party is a party and / or the fulfillment of legal obligations.

Art. 3. Processing methods: how the data is processed
The Data Controller to achieve the purposes of Art. 2 processes common data (e.g. name, surname, company name, e-mail address, telephone number, PEC address, SDI code, bank and payment references, tax code, VAT number).

Unless voluntary communications from the interested parties, the Data Controller does not process particular data pursuant to Art. 9 of the GDPR (e.g. data relating to health, political affiliation, trade union membership, etc.) and / or judicial data pursuant to Art. 10 of the GDPR (e.g. data referring to criminal convictions and / or offenses).

The data are processed within the limits strictly necessary to achieve the purposes referred to in the previous Art. 2, also with the aid of electronic or, in any case, automated means (IT tools) and the processing can also be carried out through the website of the Data Controller. .
In any case, the data processing is carried out with the adoption of all suitable measures to guarantee the security and confidentiality of the personal data of the interested parties, in particular in compliance with the security measures referred to in art. 32 of the GDPR and according to the principles of lawfulness, necessity and proportionality.

Art. 4. Data retention: where and for how long the data is kept
The data are processed and stored at the offices of the Data Controller and on the company tools used (eg computers). All data (paper and digital) are protected by adequate security systems in order to guarantee their confidentiality and protection. All data are physically stored in Italy. Some digital files are stored in cloud systems. The suppliers have been selected in order to guarantee data protection and confidentiality. These devices are physically located within the European Union.
The Data Controller will keep personal data for the time necessary to fulfill the purposes referred to in the previous Art. 2, in particular for the entire duration of the contractual relationship with customers, to fulfill the obligations imposed by current tax and anti-money laundering legislation. Personal data may be kept for a longer period in the event of any disputes, for the entire duration of the same, to allow the exercise of the Data Controller’s right of defense in judicial and extrajudicial proceedings.
The data collected and processed with reference to Art. 2 will be kept for 10 (ten) years from the end of the contractual relationship to process any requests from interested parties.

Art. 5. Data communication and transmission: to whom the data is communicated
The data are not subject to communication and disclosure to third parties, except for the obligations deriving from the law. In fulfillment of these obligations, the personal data, including banking, of customers may be transmitted to third parties who carry out the processing on behalf of the Data Controller in their capacity as external managers appointed pursuant to art. 28 GDPR (by way of example, the accountant for billing data, IT consultants for the technical assistance relationship, etc.).
Personal data may also be disclosed to credit institutions, insurance companies, law firms for the management of any disputes and the exercise of the Data Controller’s right of defense, to the competent public security authorities for investigation and inspection activities. , to employees and / or collaborators of the Data Controller in carrying out their normal work and / or collaboration activities, as persons authorized to process.
The updated list of these subjects is however available at the offices of the Data Controller.
No data is resold to third parties.

Art. 6. Rights of interested parties (Articles 15 and following of the GDPR).
Art. 15 Right of access, including the right to obtain an indication of the retention period of personal data envisaged, or if it is not possible, the criteria used to determine this period. Right to obtain information on the origin of the data collected, as well as the purposes and methods of treatment. Right to lodge a complaint with the Supervisory Authority at any time (Privacy Guarantor: Piazza Venezia nr. 11, 00187 ROME, Tel. +39 06 696771 – PEC: protocol@pec.gpdp.it); Art. 16 Right of the interested party to obtain the updating, correction or integration of personal data; Art. 17 Right to cancellation and right to be forgotten; Art. 18 Right to limitation of treatment, when foreseen; Art. 19 Obligation of the holder to notify the rectification, cancellation and / or limitation; Art. 20 Right to data portability, if the technology in place allows it; Art. 21 Right to object, at any time for reasons connected to your particular situation, in the event that the processing is carried out in the exercise of public authority or in the performance of a task of public interest or if the legitimate interest is based of the owner; Art. 22 Right to obtain information on the existence of an automated decision-making process, including profiling.

Art. 7. Instances of the interested parties: how the rights can be exercised
The requests relating to the exercise of the rights referred to in the previous Art. 6 may be presented by the interested parties to the Data Controller by registered letter or PEC (certified electronic mail) to the addresses indicated in the previous Art. 1.
In all cases, interested parties must attach their own valid identity document to the request.

1. Scope of application
These General Conditions of Sale apply to all orders placed through the site https://nomelli.it and govern and constitute an integral and substantial part of all contracts entered into through the site between Users and PANIFICIO NOMELLI SNC
As a result of placing an order, the Customer declares to have read and accepted these general conditions of sale.
The User can consult the following General Conditions of Sale on the website https://nomelli.it; you can also print or save this document, using the normal program functions.

2. Age and residence
The User who intends to register guarantees that he is of age and that the personal data provided are true, correct, updated, referring to the person who inserts them or entered them with the consent of the third party, assuming all responsibility for the correctness and truthfulness of the information provided. . Should there be any changes in the data of the Users, it will be the responsibility of the latter to inform the Seller of the updates as soon as possible.

3. Registration
In order to proceed with purchases on the site https://nomelli.it, the user has the right to register with it or proceed with the purchase as a guest user. Viewing for information purposes does not require registration.
Users who intend to register must provide some personal data and follow the registration procedure.
Registration will take place according to a procedure that initially requires the compilation of a form specially prepared on the site to collect all the necessary data; subsequently the Registered User will receive an e-mail confirming the registration. Only after this contact will it be possible to make purchases through the portal.
The Registered User must take care of the access codes and keep them confidential.
In the event of loss, theft or loss of access codes, the User must promptly notify the Seller who will proceed with the deactivation and replacement.
The User is directly and indirectly responsible for any improper and illegitimate use of the site’s features by himself or by third parties who will use the services offered by the site in his name.

4. Privacy
PANIFICIO NOMELLI SNC will proceed to the processing of the Customer’s personal data in compliance with the European Regulation n. 679 of 27 April 2016
as specified in detail in the information in the Privacy Section, to which reference should be made for more detailed information on the subject.

5. Cancellation of registration
The registered User who wishes to cancel his registration can send a communication by e-mail to the address info@pasticceriabazzoli.it.

6. Forwarding of the order and its acceptance
To order products through the site https://nomelli.it it is necessary to follow the following steps:
a) The Customer chooses, among the products offered, the good he intends to purchase by “clicking” on the appropriate button.
b) The product is included in a special so-called “shopping cart” list; the customer can change the quantities or delete products included in the aforementioned list.
c) The Customer approves the list of selected goods by “clicking” on the appropriate button.
d) The Customer provides the requested information, chooses the method of delivery and payment and, having accepted the conditions of sale, expresses his consent by “clicking” on the “confirm order” button.
e) Linea Pane sends the Customer an order confirmation e-mail with a summary of the products, their prices, the chosen means of payment and the general and particular conditions applicable to the order. Only after the customer has received the aforementioned confirmation e-mail will the contract between the parties be considered perfected and effective.
g) The forwarded order will always be viewable by the Customer by authenticating with the access credentials in their account.
e) If, due to unavailability of the products or services requested, the order should not be fully or partially executed, the Seller will inform the Customer in writing and reimburse as soon as possible the sums already paid for the part of the supply not executed.

7. Price
The price of the items for sale is shown on the site in correspondence with the image of each product.
Panificio Nomelli snc reserves the right to change prices at any time, it being understood that the price applied to the single sale will coincide with that indicated on the site at the time the order is sent. The prices displayed on the site are retail prices, including VAT.

8. Products
The essential characteristics of the products are available on the website on the web page dedicated to each item.
The graphics of the delivered products may not coincide with that shown on the site.

9. Delivery methods
The customer can choose between the following delivery methods:
a) collection of shopping by the Customer at the PANIFICIO NOMELLI SNC headquarters, located in Corteno Golgi (BS), Via Panoramica, 53
b) home delivery by courier, professional transporter, for the rest of Italy.
The User must provide a delivery address, possibly even different from the billing address, where a person available to collect the goods can certainly be found.
The delivery service is guaranteed only for homes that can be reached with the means provided by the Seller or the courier in charge (for example, homes that can only be reached via dirt roads or exclusively pedestrian streets are excluded).
The staff will only deliver the goods on the roadside in front of the entrance door of the house in order to guarantee low costs and times.
For organizational reasons and the efficiency of the Service, the expense cannot be verified or controlled by the Customer in the presence of the person in charge at the time of delivery. For any anomaly found, the Buyer may contact the Seller at the e-mail address info@nomelli.it
If the goods cannot be delivered due to the absence of the recipient or of third parties in charge, the following procedure will be followed:
– for deliveries made by professional courier, the latter will make two attempts to deliver the package; in the event of a negative outcome of the second access, the courier will contact the Customer by telephone in the evening, in order to agree on a further access. If the Customer is not traceable even by telephone, the package will be placed in storage in the courier’s area warehouse.

11. Delivery times
a) The collections at the NOMELLI bakery headquarters can be made:
– for orders placed before 14:00 the next day in the following time slots: from Monday to Saturday 8:00 – 12: 30/16: 00 – 19:30; Sunday 8:00 – 12:00.
– for orders placed after 2.00 pm on the second day following in the following time slots: from Monday to Saturday 8.00 am – 12.30 pm / 4.00 pm – 7.30 pm; Sunday 8:00 – 12:00.
b) In case of delivery by courier, the goods will be delivered according to the times indicated below:
– for orders placed before 14:00, the products will be delivered to the courier the next working day and delivered by them within 24/48 hours;
– for orders placed after 14:00, the products will be delivered to the courier on the second following working day and delivered by them within 24/48 hours.
For the smaller islands, an additional two working days are expected.
Shipments are made on Monday, Tuesday, Wednesday, Thursday.
Therefore, for orders placed on Wednesday after 2.00 pm, the goods will be delivered to the courier on the following Monday and delivered by them within 24/48 hours.
We do not ship on holidays and days before holidays.

11. Cost of the home delivery service
a) Delivery costs will not be charged for collections at the NOMELLI bakery.
b) For home deliveries made by courier the cost of transport will be charged a fixed cost of € 9.80
With a minimum order of € 75.00, shipping is free.
In any case, the cost will be calculated automatically by the system and displayed before confirming the order.

12. Limitation of Liability
The Seller cannot be held responsible for any loss, damage, incorrect or non-delivery caused by events and / or causes of force majeure or unforeseeable circumstances, such as by way of example but not limited to: natural disasters, adverse weather conditions (such as intense snowfall), any strikes (by its own or other employees), accidents to means of transport, explosions or any other cause, similar or different, occurring outside the control of the Nomelli Bakery and not attributable to it, even pre-existing, which prevents or aggravates the ‘total or partial execution of the contract.
Furthermore, the Seller cannot be held liable to the Customer for disservices or malfunctions of the Internet network that are beyond its control.
Finally, the same does not assume any responsibility for any fraudulent or illegal use by third parties of credit cards and other means of payment or for their improper use.

13. Complaints
Any disputes about the products may be raised by sending an e-mail to info@nomelli.it in the terms compatible with the characteristics of the food product sold and its perishable nature; never, in any case, beyond the expiry date indicated on the product.
Any liability relating to the bad condition of the products due to improper storage after delivery is excluded.

14. Methods of payment
Payment can be made via PayPal, Credit Card and Bank Transfer.

15. Invoicing and accompanying documents
Each order will be accompanied by a regular commercial invoice or in any case by another accompanying document and / or by a regular receipt.
16. Right of withdrawal pursuant to Legislative Decree 206/2005
The Customer’s rights are protected by Legislative Decree 206/2005 so-called Consumer Code.
As described in the aforementioned Legislative Decree the right of withdrawal is not allowed in the case of: “contracts for the supply of food, beverages or other goods for domestic use of current consumption supplied to the consumer’s home, place of residence or workplace, by distributors who make frequent and regular tours “; the purchase of products ordered through the site in question therefore does not enjoy the right of withdrawal.

17. Applicable law and jurisdiction
The contract and the general conditions of sale are governed by Italian law and must be interpreted in accordance with the same.
Any disputes connected with the use of the Website https://nomelli.it and the products offered therein are reserved to the Italian jurisdiction.

19. Disclaimer
The information provided on the site https://nomelli.it is of a general nature and for purely informative purposes, and cannot in any case replace the advice of a qualified doctor.
